Agreement on using our services

1. Scope of Application
   This agreement (this “Agreement”) shall apply to all acts of the user (the “User”) of the lesson purchase service (the “Service”) provided by the ski resort (the “Operator”).
2. Consent to this Agreement
   By using the Service, the User shall be deemed to accept the contents of this Agreement and agree to pay the price of all services (e.g. ski/snowboard lesson, events) indemnification and any other amounts in connection with the Service charged by the Operator.
3. Agreed Matters
   The User understands and agrees that once the purchase process is completed, the User shall be deemed to accept the cancellation policy and the disclaimer statement on our website.
4. Privacy Policy
   Protection and handling of the User’s personal information shall be governed by the Privacy Policy.
5. Governing Law
   This Agreement shall be governed by the laws of Japan.
6. Jurisdiction
   The Nagano District Court shall have exclusive primary jurisdiction with respect to all disputes arising with respect to this Agreement and any Services.

1. 適用範圍
   本協議（“本協議”）適用於滑雪度假村（“經營者”）提供的課程購買服務（“服務”）的所有用戶（“用戶”）行為。
2. 對本協議的同意
   通過使用本服務，用戶即被視為接受本協議的內容，並同意支付經營者收取的所有服務價格（例如滑雪/單板滑雪課程、活動）、賠償金及與服務相關的其他款項。
3. 約定事項
   用戶理解並同意，購買過程完成後，即被視為接受我們網站上的取消政策和免責聲明。
4. 隱私政策
   用戶的個人信息的保護和處理應遵循隱私政策。
5. 適用法律
   本協議應受日本法律的管轄。
6. 管轄權
   長野地方法院對於與本協議及任何服務有關的所有爭議，享有專屬的初審管轄權。
   

Privacy Policy

<This Policy>
This Privacy Policy sets forth the policy on the protection and use of personal information provided by the user (the “User”) of the services (the “Service(s)”) provided by the ski resort operator (the “Operator”) the Tourism Commission of Hakuba Village and Wasabiya Corp., which has been entrusted by the Operator to maintain, operate and support the operation of this online system (this “System”). Unless otherwise defined, terms used in this Privacy Policy have the same meaning as those set forth in the Act on the Protection of Personal Information (Act No. 57 of May 30, 2003).

<Collecting personal information>
This System will collect the below information from the User in providing the Service. The following are examples and, depending on the content of the information, may not be personal information.

• Information provided by the User in using the Service: Name, telephone number, e-mail address, place of stay, credit card number.
• Information collected automatically when the User accesses this System: IP address, data specifying mobile handset, type and version of internet browser, OS, Platform, URL visited, time and date of access, other access information.

<Privacy Policy>
The Operator, the Tourism Commission of Hakuba Village and Wasabiya Corp. will use personal information collected through the Service for the following purposes:

<Providing personal information data to third parties>
Personal information collected through the Service shall not be provided to third parties by the Operator, the Tourism Commission of Hakuba Village or Wasabiya Corp. except in the following cases:

• When outsourcing part or all of the management of personal information to provide the Service.
• When it is legally required or needed to help a government entity to execute its operation and notifying the User could cause problems in execution.
• When needed for the safety of the User’s life or property but it is difficult to obtain consent from the User. <Governing Law>
  This Privacy Policy shall be governed by the laws of Japan.

<Governing Law>
This Agreement shall be governed by the laws of Japan.

<Jurisdiction>
The Nagano District Court shall have exclusive primary jurisdiction with respect to all disputes arising with respect to this Agreement and any Services.

<本政策>
本隱私政策規定了滑雪度假村經營者（“經營者”）所提供的服務（“服務”）中，用戶（“用戶”）提供的個人信息的保護和使用政策。由白馬村觀光委員會及其委託的和咲屋（Wasabiya Corp.）負責維護、運營和支持此在線系統（“系統”）的運作。除非另有定義，本隱私政策中使用的術語具有《個人信息保護法》（2003年5月30日法第57號）中所規定的相同含義。

2. 當法律要求或為了協助政府機構執行其業務，而通知用戶可能會造成執行上的問題時。
3. 當出於用戶生命或財產的安全需要，但難以獲得用戶的同意時。

<適用法律>
本隱私政策應受日本法律的管轄。

<管轄權>
長野地方法院對於與本協議及任何服務有關的所有爭議，享有專屬的初審管轄權。

Handling of Personal Information

In accordance with the April 1st, 2005 full-scale implementation of the Act on the Protection of Personal Information, the ABLE Hakuba Goryu & Hakuba47 Ropeway Council resolves to handle the personal information of those who purchase our services with due care and in accordance with personal information laws, regulations, and cabinet minister guidelines, and protect the privacy of that information while using it for the following purposes.

• To determine the identity of customers applying for our lesson.
• To deliver information, text, and so on regarding the use of our services.
• To deliver other information and messages.
• To inform customers about special events and services planned and organized for purchasers by the ABLE Hakuba Goryu & Hakuba47 Ropeway Council. The handling of personal information may be entrusted to third parties, but in those cases, care will be taken
  to maintain sufficient security levels to protect personal information, and the appropriate and necessary oversight will be undertaken. Purchaser’s personal information (purchaser’s name, contact information) will be provided to policy office and insurance company in case of any accident occurred.

個人信息的處理

根據2005年4月1日《個人信息保護法》的全面實施，ABLE 白馬五竜滑雪場與白馬47纜車協會決定對購買我們服務的顧客的個人信息進行謹慎處理，並遵循個人信息相關的法律、法規及內閣大臣指導方針，保護該信息的隱私，同時用於以下目的：

1. 確定申請我們課程的顧客身份。
2. 發送有關使用我們服務的信息、文本等。
3. 發送其他信息和通知。
4. 通知顧客由ABLE 白馬五竜滑雪場與白馬47纜車協會計劃和組織的特別活動和服務。

個人信息的處理可能會委託第三方，但在這些情況下，我們將確保保持足夠的安全水準以保護個人信息，並進行適當和必要的監督。如果發生任何事故，購買者的個人信息（購買者姓名、聯絡信息）將提供給政策辦公室和保險公司。
